Protecting your data and privacy is important to us. This Privacy Policy (“Policy”) explains the information collection, use, and sharing practices of HulkApps Inc,  operated by Shop Circle Ltd, located in One Kingdom Street, Paddington Central, London - W2 6BD, United Kingdom. 

Unless otherwise stated, this Policy describes and governs the information collection, use, and sharing practices of HulkApps with respect to your use of our website, services (“Services”) products and applications (“Apps”) we provide and/or host on our servers.

SECTION 1 - ABOUT US

HulkApps develops products (apps/themes) and services for Shopify users-merchants (clients) and processes personal data in compliance with the applicable legal regulations on the protection of natural persons with regard to the processing of personal data.

This Privacy Policy will provide detailed information on when and why we collect your personal information, how we use it, the limited conditions under which we may disclose it to others, and how we keep it secure.

SECTION 2 - INTRODUCTION

At HulkApps Inc, operated by Shop Circle Ltd. ("us", "we", "our" or the "Company") we value your privacy and the importance of safeguarding your data. This Privacy Policy ("Privacy Policy") describes our privacy practices for the activities set out below. As per your rights, we inform you how we collect, store, access, and otherwise process information relating to individuals. In this Policy, "Personal Data" refers to any information that on its own, or in combination with other available information, can distinguish an individual. We are committed to protecting your privacy in accordance with the highest level of privacy regulation. As such, we follow the obligations under:

  • Canada's Personal Information Protection and Electronic Documents Act (PIPED) and the applicable provincial legislations
  • EU's General Protection Data Regulation (GDPR)
  • Brazil's Data Protection Legislation (LGPD)
  • California's Consumer Protection Act (CCPA) and California Online Privacy Protection Act (CalOPPA)

SCOPE

This policy applies to the HulkApps Inc. website domains, themes, applications, and services.

This Policy does not apply to third-party applications, websites, products, services, or platforms that may be accessed through (non-HulkApps Inc. ) links that we may provide to you. These sites are owned and operated independently from us, and they have their own separate privacy and data collection practices. Any personal data that you provide to these websites will be governed by the third-party's own privacy policy. We cannot accept liability for the actions or policies of these independent sites, and we are not responsible for the content or privacy practices of such sites.


SECTION 3 - PROCESSING ACTIVITIES


This Privacy Policy applies when you interact with us by doing any of the following:

  • Make use of our application and services as an authorized user
  • Visit any of our websites that link to this Privacy Statement
  • Receive any communication from us including newsletters, emails, calls, or texts.


SECTION 4 - MERCHANT SUPPORT

We receive profile and contact information (name, email address, or other information you choose to provide us) when you interact with us through installing our applications, services or themes in your Shopify store. We also send notices and updates to our merchants such as for customer support inquiries, product updates, taking surveys, participating in promotions or research.


SECTION 5 - GOOGLE API SERVICES & LIMITED USE REQUIREMENTS

Some products, specifically, "Hulk Product Reviews" use and transfer information received from Google APIs to other apps, by adhering to Google API Services User Data Policy, including Limited Use requirements.

SECTION 6 - PERSONAL DATA WE RECEIVE

When you make a purchase, or attempt to make a purchase, we receive personal data as part of your order information.

This data might include:

  • Account information such as your name, email address, and password.
  • Payment information such as your billing address, phone number, and payment methods.

If you provide us, or our service providers, with any Personal Data relating to other individuals, you represent that you have the authority to do so and acknowledge that it will be used in accordance with this Privacy Statement.


SECTION 7 - ACCESS TO YOUR PERSONAL DATA

You have the right to view, amend, or delete the information that we hold about you. All the information that our applications use is limited to you. We extend support for installation of our applications and themes, with exception to any unfounded customizations, excessive or repetitive requests, in which case we reserve the right to charge a proportionate administration fee or even refuse.


SECTION 8 - DEVICE AND USAGE DATA

When you visit our website, we automatically collect and store information about your visit using browser cookies (files that are sent by us to your computer), or similar technology. You can instruct your browser to refuse all cookies or to indicate when a cookie is being sent. The Help Feature on most browsers will provide information on how to accept cookies, disable cookies, or notify you when receiving a new cookie. If you do not accept cookies, you may not be able to use some features of our Service and we recommend that you leave them turned on. We also process information when you use our services and products. This information may include:

  • IP address and timezone
  • Individual products you view
  • Web terms or searches that led you to the site
  • Browser you used
  • Network connection
  • Unique identifiers


SECTION 9 - HOW WE USE YOUR PERSONAL DATA

When you make a purchase from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address, and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Email marketing (if applicable). We may send you emails concerning our products and services, as well as those of third parties. You may opt out of promotional emails by following the unsubscribe instructions in the promotional email itself.

HulkApps also may use your data for advertising purposes in some cases altered or anonymized. HulkApps has the right to portray previous merchants/clients work & assets on our website unless exclusively asked not to do so in written form. In the cases where we use your data, we will either exclude, render, restructure or change your data or seek permission for specific details upon discretion. HulkApps may share this data to provide information to potential business partners or prospective clients.


SECTION 10 - CONSENT

When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for marketing activities, we will either ask you directly for your expressed consent or provide you with an opportunity to say no.

SECTION 11 - THIRD-PARTIES WHO MAY RECEIVE DATA

We may receive your personal data from third parties such as vendors, legal parties and third-party marketing, advertising, and business analytics partners. This information is not collected by us but by a third party and is subject to the relevant third party's own separate privacy and data collection policies. These partners may receive information about your use of, or interactions with, our website, Products and Services, including through third-party cookies or other technologies. Providing information to third parties for personalized advertising services may be considered “sharing” for cross-context behavioral advertising, or “targeted advertising,” as defined by applicable law.

We do not have any control or input on how your personal data is handled by third parties. You may opt-out of our sharing of Personal Data for cross-context behavioral advertising or targeted advertising by using the relevant settings. As always, you have the right to review and rectify this information. The information practices of such other services, or of social media networks that host our branded social media pages, are governed by third parties' privacy statements, which you should review to better understand those third parties privacy practices.

SECTION 12 - BRAND LIKENESS AND TESTIMONIALS

HulkApps reserves the right to share and promote client likeness through testimonials and or reviews, unless we receive a written request not to from the specific client or company.

HulkApps also reserves the right to share communications gathered throughout the project as testimonials and submissions for third party and website promotion, unless we receive a written request not to from the specific client or company.

SECTION 13 - SHOPIFY POLICY

Our store is hosted on Shopify. They provide us with a platform that allows us to develop Products and Services for you. Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

SECTION 14 - LEGAL BASIS FOR THE PROCESSING PERSONAL DATA

We collect and use personal data about you with your consent to provide, maintain, and develop our Products and Services and understand how to improve them.

These purposes include:

  • Developing, customizing and improving our Products and Services
  • Deliver, maintain, debug and improve our Products and Services
  • Provide you with technical and customer support
  • Advertising, promoting and marketing our products and services, including for personalized communications or advertisements on third-party services
  • Send you newsletters and other marketing communications about current and future products, programs and services, events, competitions, surveys and promotions held by us or hosted on our behalf; and
  •  Organize events or register attendees and schedule meetings for events.

We process your personal data to provide a product or service, as it is necessary to perform contractual obligations. All of the above processing is necessary in our legitimate interests to provide products and services and to maintain our relationship with you and protect our business for example against fraud. Consent will be required to initiate services with you. New consent will be required if any changes are made to the type of data collected. Within our contract, if you fail to provide consent, some services may not be available to you.

SECTION 15 - PAYMENT PROCESSING

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. 

PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 16 - SECURITY

To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed.If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. All of the data collected by HulkApps, is stored in safe and secured locations. In the case of a data security breach we will provide precautions to keep your informations safe and encrypted. If such a breach happens, HulkApps will send you a notification with all of the details regarding the security breach.

SECTION 17 - SHARING AND DISCLOSURE

We will share your personal data with third parties only in the ways set out in this Policy or set out at the point when the personal data is collected. We also use Google Analytics and Google Tag Manager to help us understand how our visitors use the site. By using this site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

We may use or disclose your personal data in order to comply with a legal obligation, in connection with a request from a public or government authority, or in connection with court, to prevent loss of life or injury, or to protect our rights or property. Where possible and practical to do so, we will tell you in advance of such disclosure.

We may use a third party service provider, independent contractors, agencies outside the HulkApps company. We may share your personal data with marketing agencies, maintain and improve our products and services.

What are cookies?

If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.

We will only retain your personal data for as long as necessary for the purpose for which that data was collected and to the extent required by applicable law. When we no longer need personal data,we will remove it from our systems and / or take steps to anonymize it.

  • Right to Rectification (PIPEDA, GDPR Article 16, LGPD) You have the right to have incomplete or inaccurate personal data that we process about you rectified.
  • Right to be Forgotten or Right to Erasure (GDPR Article 17, CCPA, LGPD) You have the right to request that we delete personal data that we process about you, except we are not obliged to do so if we need to retain such data in order to comply with a legal obligation or to establish, exercise or defend legal claims.
  • Right to Restriction of Processing (GDPR Article 18, LGPD) You have the right to restrict our processing of your personal data where you believe such data to be inaccurate; our processing is unlawful; or if we no longer need to process such data for a particular purpose unless we are not able to delete the data due to a legal or other obligation or because you do not wish us to delete it.
  • Right to Portability (PIPEDA, GDPR Article 20, LGPD) You have the right to obtain personal data we hold about you, in a structured, electronic format, and to transmit such data to another data controller, where this is (a) personal data which you have provided to us, and (b) if we are processing that data on the basis of your consent or to perform a contract with you or the third party that subscribes to HulkApps Inc. services.
  • Right to Objection (GDPR Article 21, LGPD) Where the legal justification for our processing of your personal data is our legitimate interest, you have the right to object to such processing on grounds relating to your particular situation. We will abide by your request unless we have compelling legitimate grounds for processing which override your interests and rights, or if we need to continue to process the data for the establishment, exercise or defense of a legal claim.
  • Right Not to Be Discriminated (CCPA) You have the right not to be denied service or have an altered experience based on having executed any of your CPA rights.

 

SECTION 24 - GOOGLE INC.

This website uses Google ReCaptcha. By continuing the usage of this site, you fully accept the terms and conditions set up in the Google Terms and conditions. By accepting this terms, you will reveal you IP address and other relevant informations the Google Inc. If you do not agree to the new terms, please stop using the Service immediately, by continued use of this website you give HulkApps and Google Inc full approval.

Some of our products, specifically, "Hulk Form Builder" and "Hulk Contact Us Form" are loaded through Iframe which tracks our Iframe IP Address instead of customer/client IP Address.


SECTION 25 - WITHDRAWING CONSENT

If you have consented to our processing of your personal data, you have the right to withdraw your consent at any time, free of charge, such as where you wish to unsubscribe from marketing messages that you receive from us. If you wish to withdraw your consent, please contact us using the information found at the bottom of this page.

You can make a request to exercise any of these rights in relation to your personal data by sending the request to our privacy team by using the form below.

For your own privacy and security, at our discretion, we may require you to prove your identity before providing the requested information.

We may modify this Policy at any time. If we make changes to this Policy then we will post an updated version of this Policy on this website. When using our services, you will be asked to review and accept our Privacy Policy. In this manner, we may record your acceptance and notify you of any future changes to this Policy.
